Matt Weinick Wins First Amendment Case

After a jury trial spanning nearly two weeks, Matt Weinick won his client’s First Amendment political retaliation claim.

Taking less than two hours to deliberate, the jury quickly returned a verdict for his client, including awarding $150,000 in emotional damages. The judge will decide how much to award in back pay and front pay, but the request will be for more than half a million dollars.

During the trial, a significant legal hurdle was overcome. The defendants attempted to assert a defense on the eve of trial, but after plaintiff’s objections, the judge ruled that the belated attempt would cause plaintiff significant prejudice. The judge further ruled that even if he allowed the defendants to assert their defense, they could not prove it.
